The present investigation questions the legitimacy of the modification of the penal code regarding the prohibition of the suspension of the execution of the sentence, in the case of some crimes committed by officials or public servants that affect the public function, this is because with it, the autonomy of the judicial power is limited, since this body or power of the State is responsible for the task of determining the penalty quantitatively and qualitatively, as well as the way it is executed within the legal parameters of maximum and minimum, which is what corresponds to the legislator, according to the system adopted by Peru. To that end, the following question was asked: In what sense is the prohibition of the imposition of a sentence of deprivation of liberty suspended for the crimes of fraudulent embezzlement, collusion, embezzlement, some types of bribery and illicit enrichment, contained in the last paragraph of article 57 of the Criminal Code, violates the principle of judicial autonomy? , the following hypothesis was formulated: The prohibition of the imposition of suspended imprisonment for the crimes of fraudulent embezzlement, collusion, embezzlement, some types of bribery and illicit enrichment, contained in the last paragraph of Article 57 of the Criminal Code, violates the principle of judicial autonomy due to the fact that the legislative power is holding the function of determining the specific penalty in terms of the manner of execution, a task that is proper to the judiciary, was established as the objective: to determine that the prohibition of the imposition of punishment deprivation of liberty suspended for the crimes of fraudulent embezzlement, collusion, embezzlement, some kinds of bribery and illicit enrichment, contained in the last paragraph of Article 57 of the Criminal Code, violates the principle of judicial autonomy because the legislature is assumed the function of determining the specific penalty in terms of the manner of execution, tare that is proper to the judiciary. A simple investigation was used and the hermeneutics was appealed, in order to reach the conclusion of validating our hypothesis.
