Problem: Is there legal harmony between article 12 numeral 3 of the New Code of Criminal Procedure and article 92 of the Criminal Code, in relation to civil reparation, resulting from the acquittal and the opportunity of its determination according to the Penal Code? Objective: To determine if there is legal harmony between article 12 numeral 3 of the New Criminal Procedure Code and article 92 of the Criminal Code, regarding civil reparation, resulting from the acquittal and the opportunity of its determination according to the Penal Code. Material and Method: A structured questionnaire was applied to a sample of 80 legal professionals by variable, including Judges, Prosecutors and Lawyers. The design was nonexperimental cross-sectional. Statistical analysis was used for statistical analysis. Results: There is no legal harmony between article 12 numeral 3 of the New Code of Procedure and article 92 of the Criminal Code, in relation to civil reparation, since in the first case, the criminal judge is empowered to be able to pronounce on the Civil action, even though there is no penalty, while in the second case the civil remedy is determined jointly with the penalty. Conclusion: There is no legal harmony between the two normative bodies, which generates a legal antinomy.
