Providing an alternative to legal knowledge, the university thesis project entitled “PRIVATIVE PENALTY OF FREEDOM AND COMMUNITY SERVICES FOR FOOD DEBTORS AND ITS CONVENIENCE FOR THE INTEREST OF THE FOOD CHILDREN“ is proposed. This research responds to the need, mainly, to establish the convenience of sanctioning food debtors with the limiting penalty of the provision of food services instead of using custodial sentences because we consider that the custodial sentence is not The most appropriate because it violates several rights such as freedom, health, dignity, equality, work and financial rights. Finally, the specific objectives are to determine whether to eliminate the custodial sentence, contained in Article 149 of the Peruvian Penal Code, for maintenance debtors and to preserve community services, constitutes a measure that favors the interests of the children Food. In this sense, the research is structured in four chapters: the first chapter refers to the research problem, which addresses the approach and formulation of the problem, objectives, justification and delimitation of the study. The second chapter deals with the theoretical framework, research background, theoretical bases, hypothesis system and study variables. The third chapter refers to the arguments used for the realization of this legislative proposal since part of the above is inferred that favors the inmate and the minor child the use of the limiting penalty of provision of community services because it does not violate the rights of debtor food And prevents the criminal contagion in addition does not generate expenses for the state the imprisonment of the debtor alimentary.
