The investigation, “Right of Access to Justice for Adolescents in Peruvian Criminal Law“, is an issue that has been conceived for the study of the possibility of incorporating a new assumption within the acquired capacity within our national legislation so that In this way, it is possible to protect minors who are incapable of being victims of punishable acts and consequently can request their civil reparations within the criminal proceedings. Therefore, our study is circumscribed in national legislation (Peru). It has been proposed as objectives first, to analyze the legal regulation of the right to exercise civil action derived from a punishable act and the institute of civil reparation established in our national legislation. Second, to establish the problems that are presented in the criminal process in relation to the relative incapacities to exercise their rights as victims of the commission of crimes. Finally, identify the legal alternative that allows exercising their rights in the exercise of the action to the relative minors in the criminal process. The research methodology (qualitative research) has focused on the problem posed trying to explain from an analytical, dogmatic point of view and perspective. The results achieved show that this is a very controversial topic within the Civil and Criminal Procedure Law, due to thefact that there are currently problems in relation to the right to exercise civil action of the relative incapable minors in criminal proceedings.
