Abstract: La investigación, “Derecho de acceso a la justicia de los adolescentes en la legislación penal peruana”, es un tema que ha sido concebido para el estudio de la posibilidad de incorporar un nuevo supuesto dentro de la capacidad adquirida dentro de nuestra legislación nacional para que de esta manera pueda tutelarse a menores incapaces relativo víctimas de hechos punibles y consecuentemente puedan solicitar sus reparaciones civiles dentro de los procesos penales. Por lo tanto, nuestro estudio se circunscribe en la legislación nacional (Perú). Se ha propuesto como objetivos primero, analizar la regulación legal del derecho al ejercicio de la acción civil derivada de un hecho punible y el instituto de la reparación civil establecido en nuestra legislación nacional. Segundo, establecer los problemas que se vienen presentando dentro del proceso penal en relación a los incapaces relativos para ejercer sus derechos como víctimas de la comisión de delitos.
Finalmente, identificar la alternativa jurídica que permita ejercer sus derechos en el ejercicio de la acción a los menores relativos dentro del proceso penal. La metodología de investigación realizada (investigación cualitativa) se ha enfocado el problema planteado tratando de explicar desde un punto de vista analítico, dogmático y su perspectiva. Los resultados alcanzados demuestran que se trata de un tema bastante polémico dentro del Derecho Civil y Procesal Penal, debido a que en la actualidad se vienen presentando problemas en relación al derecho de ejercicio de la acción civil de los menores incapaces relativos dentro de los procesos penales.
The investigation, “Right of Access to Justice for Adolescents in Peruvian Criminal Law“, is an issue that has been conceived for the study of the possibility of incorporating a new assumption within the acquired capacity within our national legislation so that In this way, it is possible to protect minors who are incapable of being victims of punishable acts and consequently can request their civil reparations within the criminal proceedings. Therefore, our study is circumscribed in national legislation (Peru). It has been proposed as objectives first, to analyze the legal regulation of the right to exercise civil action derived from a punishable act and the institute of civil reparation established in our national legislation. Second, to establish the problems that are presented in the criminal process in relation to the relative incapacities to exercise their rights as victims of the commission of crimes. Finally, identify the legal alternative that allows exercising their rights in the exercise of the action to the relative minors in the criminal process. The research methodology (qualitative research) has focused on the problem posed trying to explain from an analytical, dogmatic point of view and perspective. The results achieved show that this is a very controversial topic within the Civil and Criminal Procedure Law, due to thefact that there are currently problems in relation to the right to exercise civil action of the relative incapable minors in criminal proceedings.
