Abstract: La presente investigación tuvo por objetivo general determinar si existen fundamentos jurídicos y
fácticos y doctrinarios para la revisión judicial con relación a los denominados Regímenes de
Tenencia y de Visitas existentes, con el fin de poder prevenir la aparición y/o eliminación
progresiva de la denominada Alienación Parental que haya afectado a un menor o adolescente que
se hay encontrado inmerso en un proceso judicial sobre lo referido líneas más arriba, se postuló
como hipótesis general que, existen fundamentos jurídicos y fácticos y doctrinarios sobre la
revisión de los regímenes de tenencia y de visitas para prevenir la aparición del síndrome de
alienación parental. La investigación fue cualitativa, la técnica de recolección de datos fue la de
Análisis de textos, las hipótesis fueron validadas y la conclusión principal fue que dentro de los
procesos judiciales sobre regímenes de Tenencia y de Visitas, existe una creciente vulnerabilidad
y una afectación psicológica de carácter progresivo con relación a todo menor y/o adolescente que
viva un resquebrajamiento familiar a través de la separación del vínculo familiar, producto de
muchos factores, tales como la separación de hecho, abandono de hogar por parte de cualquiera de
las figuras paternas, y sobre todo por la actividad persuasoria de parte de ambos padres y de ser
el caso por parte de terceros afines al vínculo familiar preexistente. Asimismo, la recomendación
más importante se centra en la incorporación legal de preceptos legales de manera sustantiva en
los diferentes cuerpos legales con carácter exclusivo para poder establecer medios de control,
supervisión psicológica continua, y eliminación de trastornos como lo es el denominado Síndrome
de Alienación Parental, entre otros.
The general objective of this investigation was to determine if there are legal and factual grounds for judicial review in relation to the so-called existing Tenure and Visitation Regimes, in order to prevent the appearance and/or progressive elimination of the so-called Parental Alienation that has affected a minor or adolescent who has been immersed in a judicial process regarding the aforementioned lines, it was postulated as a general hypothesis that, there are legal and factual bases on the revision of the custody and visitation regimes to prevent the appearance of parental alienation syndrome. The research was qualitative, the data collection technique was that of text analysis, the hypotheses were validated and the main conclusion was that within the judicial processes on custody and visitation regimes, there is a growing vulnerability and psychological affectation of progressive character in relation to any minor and/or adolescent who experiences a family breakdown through the separation of the family bond, product of many factors, such as the de facto separation, abandonment of home by any of the parental figures, and especially due to the persuasive activity on the part of both parents and, if applicable, by third parties related to the pre- existing family bond. Likewise, the most important recommendation focuses on the legal incorporation of legal precepts in a substantive manner in the different legal bodies with an exclusive character in order to establish means of control, continuous psychological supervision, and elimination of disorders such as the so-called Parental Alienation Syndrome., among others.
