The problem of the investigation lies in the possibility of applying the special process of early termination during the Intermediate Stage of the common criminal process, since on the one hand there is a position that maintains, if its application is feasible, by reason of an interpretation teleological of the criminal process, and the opportunity of the same is until before the oralization of the accusatory requirement begins; and, in contrast to this, there is a position contrary to it, which maintains that its application is impossible, because it lacks a legal basis and if applied, the entire criminal process is distorted The OBJECTIVE of this investigation is to analyze the problem to standardize the jurisprudence around the application of the special process of early termination in the intermediate stage; The MEDOTODOLOGY of the present investigation is of a qualitative type and has a dogmatic design; likewise, the RESULTS of this investigation, in the first place, are aimed at standardizing the jurisprudence regarding the application of the special process of early termination in the intermediate stage; and secondly, to establish a regulatory framework that requires that its application proceed before the oralization of the accusatory requirement.
