Los títulos archivados en el artículo 2014 del código civil y la influencia del tráfico comercial inmobiliario en Sunarp-Cusco AF-2016.

Abstract

La presente investigación busca determinar si la entrada en vigencia de la Ley 30313 “Ley de Oposición al Procedimiento de Inscripción Registral en trámite y cancelación del Asiento Registral por Suplantación de Identidad o Falsificación de Documentación y Modificatoria de los Artículos 2013° y 2014° del Código Civil y de los artículos 4° y 55° y la Quinta y Sexta Disposiciones Complementarias Transitorias y Finales del Decreto Legislativo 1049” – específicamente la modificación del Artículo 2014° del Código Civil – que para la alegación de ésta, se debe cumplir una serie de presupuestos, vulnerando con ello un Principio Rector del Sistema Registral: El Principio de Legitimación consagrado en el artículo 2013° del Código Civil. Actualmente, la persona natural o jurídica al realizar una adquisición de un bien y siendo ésta onerosa, se requiere de la mayor certeza posible respecto de si la adquisición del bien se da en base del verdadero propietario; así confiando en el Estado a través de su Institución encargada y especializada, con la información que brinda la misma por medio de su Asientos Registrales, se llega adquirir derechos; sin embargo se ve afectada cuando es la misma Ley materia de la presente investigación - Ley N° 30313 – la que deja sin fundamentos, ni sustento a los demás Principios Registrales. El presente trabajo tiene un enfoque cualitativo, porque describirá las consecuencias jurídicas que acarrea la entrada en vigencia de la Ley en mención, para contestar las preguntas de investigación. De igual forma la investigación es de tipo dogmático – explicativo, porque se analiza los Principios Registrales con un exhaustivo análisis.

The present investigation seeks to determine if the entry into force of Law 30313 “Law of Opposition to the Procedure of Registration in process and cancellation of the registry entry for impersonation or falsification of documentation and modification of articles 2013 and 2014 of the Civil Code and Of articles 4 and 55 and the fifth and sixth supplementary transitional and final provisions of Legislative Decree 1049 “- specifically the modification of Article 2014 of the Civil Code - for the allegation of this, a number of requirements must be met, thereby violating a Guiding Principle of the Registration System: The Principle of Legitimacy enshrined in Article 2013 of the Civil Code. Currently, the natural or legal person when making an acquisition of a property and being this onerous, requires the greatest possible certainty as to whether the acquisition of the property is given on the basis of the true owner; Thus trusting in the State through its Institution in charge and specialized, with the information that provides the same through its registry seats you get to acquire rights; However, it is affected when it is the same Law of this investigation - Law No. 30313 - that leaves without foundation, nor sustenance to the other Registration Principles. The present work has a qualitative approach, because it will describe the legal consequences that entails the entry into force of the Law in question, to answer the research questions, thus checking the hypothesis. In the same way the research is dogmatic - explanatory, because the Registration Principles are analyzed with an exhaustive analysis. Key words: Acquirers in good faith, registry, legitimation.
