Abstract: La presente investigación ha tenido por objeto realizar un análisis jurídico
trascendente para determinar las razones para incluir la presunción de paternidad en
la unión de hecho en el código civil peruano de 1984; de igual forma, determinar el
tratamiento jurídico que se da a la presunción de paternidad en la unión de hecho en
el derecho comparado, en relación al Código Civil peruano de 1984, y establecer el
perjuicio que se genera a los niños nacidos de una unión de hecho, por falta de
presunción de paternidad en el Código Civil peruano de 1984. Así mismo, esta
investigación presenta un estudio dogmático propositiva para instituir una fórmula
legal para establecer la presunción de paternidad en la unión de hecho en el código
civil de 1984, ya que la realidad que presenta la unión de hecho en el Perú, se puede
apreciar a través de la comparación de los Censos de 1981, 1993, 2007 y 2017, donde
se puede ver un crecimiento en la población que prefiere la unión de hecho, y una
disminución en la población casada, por lo que la cantidad de niños nacidos de una
unión de hecho ha aumentado y estos están quedando desprotegidos por nuestro
ordenamiento jurídico. Por consiguiente, se justifica la existencia de razones
suficientes para plantear una regulación de la presunción de paternidad en la unión
de hecho; en aras de salvaguardar el interés superior del niño, y la protección de la
familia.
The purpose of this research has been to carry out a transcendental legal analysis to determine the reasons to include the presumption of paternity in the de facto union in the Peruvian Civil Code of 1984, in the same way to determine the legal treatment given to the presumption of paternity in the de facto union in comparative law, in relation to the Peruvian Civil Code of 1984, and to establish the detriment that is generated to the children born of a de facto union, due to the lack of presumption of paternity in the Peruvian Civil Code of 1984. This is why this research has a dogmatic propositional study in order to carried out a legal formula to establish the presumption of paternity in the de facto union in the 1984 Peruvian Civil Code, since the reality that presents the de facto union in Peru, can be appreciated through the comparison of the 1981, 1993, 2007 and 2017 Censuses, where we can see An increase in the population that prefers de facto union, and a decrease in the married population, so the number of children born from a de facto union has increased and these are being left unprotected by our legal system. Consequently, it is justified the existence of sufficient reasons to propose a way to regulate the presumption of paternity in the de facto union; in order to safeguard the best interest of the child and the protection of the family.
