Abstract: La transferencia de propiedad de bienes muebles en especial el vehicular a lo largo de la historia
dentro de los Registros Públicos, ha sufrido diversas modificaciones y dicho ello podemos
deducir que se ha pretendido dotar de seguridad jurídica, sin embargo el tratamiento jurídico
normativo es deficiente, por cuanto y haciendo un breve análisis se tiene que en el Código
Civil, Reglamento Nacional de Vehículos, Reglamento de inscripciones de bienes vinculados
a la pequeña minería y minería artesanal en el registro de bienes muebles y el Texto Único
Ordenado del Reglamento General de Registros Público, no se dispone de forma expresa y
directa logrando así que dicha situación jurídica tenga eficacia, sin embargo encontramos
diversas normas que contienen disposiciones legales referidas a la inscripción de los vehículos
de transporte terrestre, comercialización de equipos y maquinarias pesadas y por tanto la
trasferencia e inscripción como tal, se han visto afectados por la inseguridad jurídica, cabe
hacer mención muchos de estos equipos y vehículos pesados carecen de una identificación e
individualización plena, por no contar con una placa única nacional de rodaje, considerando
que cuya finalidad de este elemento es la identificación e individualización única par a cada
vehículo dentro del territorio nacional, haciendo mención que estos (placas), están diseñados
con altos estándares de seguridad internacional para así estos no sufran adulteraciones,
falsificaciones o uso indebido, conforme es señalado que cuya diferencia radica en la
identificación e individualización notoria de un vehículo de uso común, tanto que es más
espontaneo y simple, puesto que muchos de estos vehículos cumplen con una inscripción
registral, bajo un criterio de cumplimiento de requisitos obligatorios estipulados en el
ordenamiento jurídico, y conforme se tiene como prioridad alcanzar una validez optima de la
transferencia y llegar a la plenitud de la seguridad jurídica, conforme se vendrá señalando
también que una la inscripción de transferencias vehiculares son constitutivas, tanto que así el
Sistema Registral Peruano. En cuanto como tal, la presente investigación tiene la inquietud temática que se centra en
determinar si al realizar una transferencia de equipos y vehículo pesado, logramos alcanzar la
denominada seguridad jurídica, siendo así que, para de esta manera podamos ir permitiendo
eliminar la incertidumbre de la situación antes descrita, y cuyo fin será de determinar la
naturaleza de los efectos jurídicos.
Ciertamente en el caso concreto de la seguridad jurídica en la transferencia de equipos y
vehículos pesados, el tratamiento registral y a la fecha de la presente investigación, solo ha sido
materializada de manera privada y es ciertos casos de manera notarial.
