Afectación al plazo razonable en los recursos impugnativos de la Ley N° 29131

Abstract

La presente investigación ha sido denominada “AFECTACIÓN AL PLAZO RAZONABLE EN LOS RECURSOS IMPUGNATIVOS DE LA LEY N° 29131”. El cual se realizó para obtener el título profesional de abogado, el cual ha sido hecha por medio de un estudio de un análisis cualitativo, que permitió identificar las causas de dicho problema; siendo de esa forma su primordial objetivo, es la aplicación de la Ley N° 29131, en contravención al Texto Único Ordenado de la Ley N° 27444, regula con suficiencia y eficacia el plazo razonable para la interposición de recursos impugnatorios; con la finalidad de desarrollar aportes y recomendaciones que contribuyan a la correcta aplicación de los reglamentos de nuestro cuerpo normativo, una mejor interpretación del conocimiento jurídico en las escuelas de formación militar, es por ello que en la actualidad el Tribunal Constitucional viene desarrollando el derecho del plazo razonable como parte del derecho al debido procedimiento, establecido en el cuerpo normativo inciso N° 3 artículo N° 139 de la Constitución Política del Estado y en los instrumentos internacionales donde nuestro País es miembro, sino también en el ámbito de los procesos administrativos, e incluso en los procedimientos del Régimen Disciplinario de las Fuerzas Armadas Ley N° 29131. Es por ello que, la investigación gira en cuanto al tema del plazo razonable en los recursos impugnativos de la Ley N° 29131, por lo que se puede evidenciar que existe una afectación clara al debido procedimiento, principio de legalidad, principio razonabilidad, y fundamentalmente el principio de eficacia, contemplado en el Título preliminar del Texto Único Ordenado de la Ley N° 27444.

This investigation has been called “AFFECTATION TO THE REASONABLE TERM IN THE CHALLENGING RESOURCES OF LAW N° 29131”. Which was carried out to obtain the professional title of lawyer, which has been done through a study of a qualitative analysis, which allowed identifying the causes of said problem; thus being its primary objective, to determine what is the effect on the term to file the appeal for reconsideration of Law No. 29131, in relation to the T.U.O of Law 27444; with the purpose of developing contributions and recommendations that contribute to the correct application of the regulations of our normative body, a better interpretation of legal knowledge in military training schools, that is why the Constitutional Court is currently developing the right of reasonable term as part of the right to due process, established in the normative body subsection No. 3 article No. 139 of the Political Constitution of the State and in the international instruments where our Country is a member, but also in the field of administrative processes, and even in the procedures of the Disciplinary Regime of the Armed Forces Law No. 29131. That is why the investigation revolves around the issue of reasonable time in appeals challenging Law No. 29131, so it can be shown that there is a clear impact on due process, the principle of legality, the principle of reasonableness, and fundamentally the principle of effectiveness, contemplated in the preliminary Title of the T.U.O of Law 27444.
