Abstract: La presente investigación radica en la categoría de estudio principal: La Rebeldía, que es el
instituto jurídico procesal que se utiliza en todos los procesos judiciales (no penales), el
castigo que la ley procesal ha adoptado para aquellas personas que pese han sido notificadas
correctamente con la demanda, no se pronuncian, no contestan, no se apersonan, sin embargo
han tomado conocimiento que sobre él pesa una demanda con una pretensión, por lo que se
le otorga un plazo para poder contestar, pronunciarse, sin embargo no lo hace,
específicamente en ese punto la ley ha establecido la figura jurídica de la rebeldía en su
artículo 458° del Código Procesal Civil para que el órgano jurisdiccional lo declare siempre
y cuando sucedan esos hechos, es decir, es el castigo al demandado rebelde, renuente,
evasivo, que no quiere comparecer al proceso y cree que porque no comparece va a
entorpecer o paralizar la actividad o el discurrir del desarrollo del proceso y justamente es
ahí donde se aplica.
El órgano jurisdiccional, los jueces tienen la facultad que la ley les da para que puedan
declarar en materia civil rebelde al demandado sin embargo el proceso continúa, se pasa a
otra etapa, pero ¿Cuál es el problema ahora? Y es que los jueces utilizan la rebeldía de
manera indiscriminada, no solo lo utilizan para aquel que es evasivo o no se presenta, sino
para todos aquellos supuestos casos que las partes no cumplen en dos, tres, cinco días su
requerimiento, entonces son declarados rebeldes.
Es una preocupación ya que se estaría desnaturalizando la aplicación de la rebeldía, que ha
sido creada solamente para esos actos, pero ya lo utilizan para otros pequeños actos que a
larga perjudica el derecho de defensa, perjudica la actividad probatoria, el debido proceso y
además que el mismo juez pueda hacer un pronunciamiento válido con la sentencia.
En el Capítulo I se presenta el planteamiento de la problemática que consiste que, en la praxis
judicial la mayoría de los órganos jurisdiccionales en el Distrito Judicial de Madre de Dios,
en procesos civiles utilizan al instituto jurídico procesal de la rebeldía de manera genérica e
indiscriminada desnaturalizando su esencia y aplicando de forma desmedida para todos los
casos. El propósito u objetivo de la presente investigación es determinar las razones jurídicas
sustantivas y adjetivas que justifiquen la aplicación desnaturalizada de la rebeldía en el
proceso civil y el desarrollo de la parte metodológica de la investigación. En el Capítulo II se desarrolla el marco teórico, en el cual se abordarán los aspectos
fundamentales para realizar esta investigación a profundidad, tales como antecedentes de
estudio, bases teóricas, definiciones de términos, entre otros puntos que fueron utilizados
como herramientas para la realización del presente estudio.
En el Capítulo III, se desarrolla y sustenta la metodología utilizada para el correcto desarrollo
de la presente investigación.
En el Capítulo IV encontraremos el desarrollo temático, abarcando en sub capítulos la parte
doctrinaria, concepto, naturaleza jurídica, efectos. Todo ello respaldado en bibliografías,
jurisprudencias, así como antecedentes de investigación anteriores.
En el Capítulo V desarrollaremos los resultados y análisis de los hallazgos que resultan de
nuestro desarrollo temático, así como la implementación y aplicación de un cuestionario de
preguntas a los abogados litigantes para saber su opinión acerca de la rebeldía y el análisis
correspondiente de los expedientes judiciales, es decir, comprobaremos si el producto de
presentado se ajusta conforme a la hipótesis planteada.
Finalmente, las conclusiones de la tesis “LA APLICACIÓN DESNATURALIZADA DE LA
REBELDÍA EN EL PROCESO CIVIL”, tipificado en su artículo 458° del Código Procesal
Civil indica que no existen razones o fundamento jurídico que justifique la aplicación
desnaturalizada de la rebeldía en un proceso judicial, por cuanto el análisis y hallazgo
realizado nos demuestra lo contrario es decir que confirma la hipótesis planteada de la
rebeldía, que se viene aplicando de manera desnaturalizada por los órganos jurisdiccionales
de la Corte Superior de Justicia de Madre de Dios, generando afectación al derecho de
defensa, al derecho de contradicción, al derecho a la prueba, al debido proceso y la tutela
jurídica efectiva.
Y terminando con las recomendaciones o sugerencias del investigador tras el desarrollo de
la investigación, así como la bibliografía que ha sido utilizada y los anexos correspondientes.
