Abstract: Esta Tesis tiene la finalidad de conocer cuál es el criterio de los jueces al motivar y determinar el pago de reparación civil en sentencias absolutorias ya que este tipo de sentencia absuelve al procesado y se entiende que no hubo delito.
Al condenar con una reparación civil, luego de ser absuelto el procesado, se estaría vulnerando el principio de legalidad, como bien lo dice el Código Penal Peruano “nadie puede ser sancionado por acto no previsto como delito o falta…” sin embargo el NCPP en su artículo 12, inciso 3 dice: “la sentencia absolutoria o el auto de sobreseimiento no impedirá al órgano jurisdiccional pronunciarse sobre la acción civil derivada del hecho punible válidamente ejercida, cuando proceda” pero hay que tener en claro esta última parte que dice “CUANDO PROCEDA” , y ¿en qué casos procede?, nuestra norma no es especifica en este aspecto.
This thesis has the purpose of knowing the criterion of the judges to motivate and determine the payment of civil damages in acquittals or dismissal, since this type of sentence absolves the accused and it is understood that there was no crime and consequently No harm done. In condemning with civil reparation, after being acquitted the accused, would be violating the principle of legality, as the Peruvian Criminal Code says “nobody can be punished for an act not foreseen as a crime or lack ...“ however the New Criminal Procedure Code in Article 12, paragraph 3 states: “The acquittal or the order of dismissal shall not prevent the court from ruling on the civil action derived from the validly punishable act, when applicable“, but this latter part, which reads “WHEN PROCED “, and in what cases, our standard is specific in this regard.
