Derogación de la exención de responsabilidad penal a los agentes del delito de minería ilegal (Propuesta legislativa).

Abstract

En el presente trabajo de investigación busca fundamentar nuestra problemática del día a día que se incrementa a pasos agigantados siendo un problema de índole social y jurídico, afectando múltiples bienes jurídicos fundamentales de la persona, pues nos referimos a la derogatoria de la Exención de Responsabilidad Penal a los Agentes del Delito de Minería Ilegal. En el Capítulo I de nuestra tesis nos refiere el problema y los aspectos metodológicos del estudio que se aborda en el trabajo. En el Capítulo II, abordamos los antecedentes de nuestra tesis, anteriores investigaciones por otros autores. En el Capítulo III, IV, V,VI, VII comenzaremos a profundizar los temas preliminares que son fundamentales en estudiar para ir entendiendo el problema en sí; siendo estos capítulos sobre La Minería en el Perú, el delito de Minería Ilegal , Eximentes de Responsabilidad Penal y el Tratamiento Especial de Exención de Responsabilidad Penal a los Agentes del Delito de Minería Ilegal donde profundizaremos más sobre nuestro problema el por qué debe derogarse la exención de responsabilidad penal a los agentes del delito de Minería Ilegal.

In this research work seeks to substantiate our day-to-day problems that increases by leaps and bounds being a problem of social and legal nature, affecting multiple fundamental legal rights of the person, as we refer to the repeal of the Exemption of Criminal Liability to Illegal Mining Crime Agents. In Chapter I of our thesis, we discuss the problem and the methodological aspects of the study that is addressed in the work. In Chapter II, we address the background of our thesis, previous research by other authors. In Chapter III, IV, V, VI, VII we will begin to deepen the preliminary issues that are fundamental in studying to understand the problem itself; being these chapters on Mining in Peru, the crime of Illegal Mining, Exemptions of Criminal Responsibility and the Special Treatment of Exemption of Criminal Liability to the Agents of Illegal Mining Crime where we will deepen more about our problem why the exemption should be repealed of criminal responsibility to the agents of the crime of Illegal Mining.
