Abstract: El presente trabajo de investigación, tiene por objetivo delimitar la legitimidad en la
actuación policial, así como advertir los derechos y deberes del ciudadano ante una
intervención policial vehicular, bajo el sustento y amparo de la normatividad de tránsito,
en concordancia con la Constitución Política del Perú y el Código Procesal Penal.
Así mismo, se empleó un análisis descriptivo exploratorio, utilizando un enfoque de
investigación cualitativa; para recopilar información utilizamos el análisis documental
basado en la legislación, doctrina y preponderando el análisis casuístico audiovisual en
razón a que se tiene como propósito demostrar que en muchos casos se realizan
intervenciones lesivas a los derechos de los ciudadanos a causa de factores como: el
desconocimiento de las normas de tránsito por parte de la ciudadanía y el mal
procedimiento del personal policial, ocasionando una falta de legitimidad ante la
credibilidad de la población.
The present research work aims to delimit the legitimacy in police action, as well as warn the rights and duties of the citizen before a vehicular police intervention, under the support and protection of traffic regulations, in accordance with the Political Constitution of Peru and the Criminal Procedure Code. Likewise, an exploratory descriptive analysis was used, using a qualitative research approach; To collect information we use documentary analysis based on legislation, doctrine and preponderating the audiovisual casuistic analysis because it is intended to demonstrate that in many cases interventions harmful to the rights of citizens are carried out due to factors such as: ignorance of traffic rules by citizens and bad procedure of police personnel, causing a lack of legitimacy in the face of the credibility of the population.
