Abstract: La presente investigación tiene por objetivo, determinar cuáles son los criterios para establecer la tenencia en el primer juzgado de familia, Tarapoto, durante el periodo 2020-2021. Esta investigación presenta un enfoque cualitativo. En esta investigación hubo dos poblaciones, la primera, lo forman 2 jueces y 6 abogados litigantes, y la segunda población, estuvo constituida por 10 sentencias emitidas por el juzgado de familia de la provincia de Tarapoto. En la presente investigación se absolverá la siguiente pregunta, ¿Cuáles son los criterios para determinar la tenencia en el primer juzgado de familia de Tarapoto, en los años 2020 y 2021? Cuya pregunta se intentó resolver y se concluyó que el criterio mayor utilizado en el primer juzgado de Tarapoto para determinar la tenencia es el Interés superior del niño como prioridad principal ya que su bienestar se deberá proteger y anteponer ante cualquier interés de los padres, desde luego ya se tendrá que examinar otros criterios de forma secundaria como el entorno en el que vive y la estabilidad emocional y económica que le pueden brindar sus progenitores.
The objective of this investigation is to determine the criteria to establish possession in the first family court, Tarapoto, during the period 2020-2021. This research presents a qualitative approach. In this investigation there were two populations, the first, made up of 2 judges and 5 litigating lawyers, and the second population, was made up of 10 sentences issued by the family court of the province of Tarapoto. In the present investigation, the following question will be answered: What are the criteria to determine shared possession in the first family court of Tarapoto, in the years 2020 and 2021? Whose question was attempted to be resolved and it was concluded that the major criterion used in the Tarapoto court to determine joint possession is the best interest of the child as the main priority since their well-being must be protected and put before any interest of the parents, of course Other criteria will have to be examined secondarily, such as the environment in which they live and the emotional and economic stability that they can provide to their parents.
