Abstract: La investigación delimita la importancia del control normativo sobre contratos en tecnología y su relación con la transferencia tecnológica. Se analizaron los conceptos relativos a la transferencia tecnológica enumerando desde el enfoque normativo las principales dificultades que enfrenta el Perú como país receptor, la relación del proceso con el Derecho de Propiedad Intelectual (DPI); La formalización del contrato de transferencia tecnológica según el régimen regulatorio, la estructura básica del contrato con las principales cláusulas restrictivas que suelen formar parte de los mismos. Se analiza el ejercicio del control estatal sobre estos contratos incluyendo la exploración de aquellos principios contractuales relacionada, el detalle de regulación directa e indirecta en el caso peruano. En el escenario actual, este proceso de transferencia se configura como una herramienta importante del Perú como país que acelera su crecimiento económico carente de normativa especializada. El presente estudio aplicó investigación documental y bibliográfica con método inductivo de estructura monográfica. Con la recopilación de información y análisis posterior, se pudo concluir que nuestro país como receptor tecnológico tiene dificultades en desarrollar las propias y explotar de mejor manera tecnologías recibidas. Esto se deriva de una serie de factores sociales, económicos, gubernamentales, pero también de la forma como se estructuran los contratos, presentando condiciones restrictivas que terminan impidiendo una explotación legítima con desventajas.
The research delimits the importance of regulatory control regarding technological contracts, relating it to transfers of its content to receiving countries. It seeks to understand the entire process of technology transfer as a whole, the obstacles that Peru faces in this type of contract are analyzed, addressing the relationship with intellectual property rights (IPR); This research aims to identify, from the legal technique, the meaning contained in the form of technology transfer contracts provided as a legal framework little discussed in our country, its debate in favor of science, technology and innovation being important. The research integrates the concept of technology transfer contracts in the absence of a national legal framework in improving regulatory tools in innovation, identifying the legal devices that relate to technology transfer contracts, relating contractual agreements with the aim of a better understanding that facilitates the construction of rules and processes in relation to this new contractual instrument according to the needs of the country. Bibliographical and documentary inquiries about inductive methods with monographic presentation were carried out. Compiling information that was analyzed later, concluding how the receiving country had difficulties in the development of technologies. The elements of a social, economic and governmental nature are the cause of the problem and the formalization of contracts accelerates the situation with great disadvantage.
