This academic article centrally addresses the issue of the performance of the third party interested in the crime of influence peddling. Therefore, by means of this document, an attempt is made to respond with solvency to the question of whether the action of the third party interested in this crime is punishable? but from a different perspective than that outlined in Plenary Agreement No. 3-2015/ CIJ-116. Thus, for this purpose, the author has structured this article into three sections. The first section is aimed at exposing the central aspects of this crime. The second section is aimed at addressing influence peddling as a crime of necessary intervention and, specifically, in the subcategory of cases in which the conduct of the intervener is not sanctioned by any criminal law, despite the fact that this one obtains a benefit for the author's action And, finally, the third section presents the author's position on the subject, as it points out that -always and in all cases- the third party interested in the crime of influence peddling responds as a participant. This is that, depending on the context of the case, the influence buyer may respond as primary accomplice or as an instigator.
