Abstract: El presente trabajo de suficiencia profesional, versa sobre la Casación Nº 1177-2019- Cusco.
El método utilizado se basa en la determinación de los hechos relevantes del caso, seguido del
desarrollo de los problemas jurídicos, luego, se realiza el análisis de cada uno de estos
problemas, la posición de la Bachillera, conclusiones y recomendaciones. Asimismo, se
observa que la Señora Gregoria habría sido víctima de agresiones físicas y psicológicas en un
contexto de violencia basada en género por parte de su conviviente; sin embargo, no encontró
justicia, ya que los operadores de justicia le imputaron al agresor el delito de agresiones contra
las mujeres y no el delito de feminicidio en grado de tentativa.
En este sentido, se concluye una insuficiencia para valorar los elementos del tipo penal de
feminicidio, ya que la Corte solo se habría centrado en valorar la idoneidad del arma y el
nivel de las lesiones ocasionadas por parte del agresor como problema principal, ya que el
análisis del caso carece de una debida argumentación y falta de motivación para sustentar la
decisión adoptada. Finalmente, los operadores de justicia no aplicaron la perspectiva de
género en el caso concreto, lo cual resulta nocivo para el estudio de los delitos cometidos en
contextos de violencia de género. Este enfoque tiene que ser utilizado en concordancia con
los estándares internacionales para lograr un Perú con justicia social e igualdad de derechos.
This professional sufficiency work is about the Cassation Nº 1177-2019-Cusco. The method used is based on determining the relevant facts of the case, followed by the development of the legal issues. Then, an analysis of each of these issues is carried out, considering the position of the Bachelor, conclusions, and recommendations. It is observed that Mrs. Gregoria was allegedly a victim of physical and psychological abuse in a context of genderbased violence by her cohabitant. However, she did not find justice as the judicial operators charged the perpetrator with the offense of assaults against women instead of attempted feminicide. In this regard, there is a lack of adequacy in assessing the elements of the crime of feminicide since the Court only focused on evaluating the suitability of the weapon and the level of injuries caused by the perpetrator as the main issue. The analysis of the case lacks proper reasoning and motivation to support the decision made. Finally, the judicial operators did not apply a gender perspective in the specific case, which is detrimental to the study of crimes committed in the context of gender-based violence. This approach needs to be used in line with international standards to achieve a Peru with social justice and equal rights.
