Abstract: El informe analiza la sentencia del Tribunal Constitucional que ordenó a RENIEC inscribir
sin revelar el nombre de la madre a los hijos de Ricardo Morán quienes nacieron a partir de
la técnica de maternidad subrogada. El principal problema jurídico es si es
constitucionalmente posible negar la inscripción de niños nacidos por maternidad subrogada
debido a la supuesta ilicitud de esta técnica. El análisis concluye que no es posible negar la
inscripción por falta de regulación de la maternidad subrogada, pues ello vulneraría derechos
como la igualdad, identidad y nacionalidad de los menores. Si bien la maternidad subrogada
plantea dilemas éticos por posibles riesgos de explotación, se considera necesario regular
para proteger los derechos reproductivos, con salvaguardas para evitar abusos. Además, se
sostiene que no era necesario que exista regulación previa sobre maternidad subrogada
para proceder con la inscripción, pues el Estado tiene la obligación de garantizar los
derechos de los niños más allá de vacíos normativos. El Tribunal Constitucional debió
establecer parámetros para evitar que en el futuro se sigan vulnerando derechos en casos
similares. En conclusión, el fallo fue acertado, pero el Tribunal perdió la oportunidad de
abordar de manera integral la problemática de la maternidad subrogada y su regulación en
el Perú.
