The article seeks to present basic notions on advertising and the Principio de Adecuación Social, as well as the position taken in the Ley de Represión de la Competencia Desleal and the Código de Protección y Defensa del Consumidor. Likewise, a comparison will be made with the Spanish and Dutch legislation. For a more dynamic explanation, this will be explained from a Fashion Law perspective, and I will analyze Dolce & Gabbana’s controversial advertisement, where model Zuo Ye tried to eat Italian dishes with chopsticks, and I will apply the national regulation. This will be made to analyze whether this advertisement would have been sanctioned in Peru. Afterwards, recommendations will be provided to elucidate who is in a better position to sanction advertisements that violate the principle, either through the Instituto Nacional de Defensa de la Competencia y de la Propiedad Intelectual (Indecopi), or through self-regulation; and the role played by the economic analysis of law in the peruvian market. Finally, conclusions and brief recommendations will be presented, which may complement future reasoning by Indecopi’s Sala Especializada en Competencia Desleal del Indecopi.
