Abstract: Nuestra investigación se titula: DELITO CONTRA EL PATRIMONIO “EL
ROBO AGRAVADO” LIMA, luego de observada la realidad problemática,
propusimos:
El problema general. ¿Cuál es la punibilidad del el robo agravado - Lima,
El Objetivo general traza el fin del estudio. Analizar la punibilidad del el robo
agravado – Lima.
Y la Hipótesis General; La punibilidad del robo agravado, tiene la máxima
sanción; que viene a ser cadena perpetua.
Tanto la doctrina como el Derecho sustantivo, coinciden en señalar, que el robo
agravado es uno de los delitos más graves, entre las figuras típicas del título
Delitos Contra el Patrimonio; siendo sus caracteres más objetivos: La
violencia o la amenaza, las que cuales están presentes de inicio a fin en la
modalidad de tercer grado; causando la muerte, o lesiones graves físicas o
mentales para consumar la apropiación del bien objeto de la acción ilícita.
Por lo tanto, se constituye como un tipo penal completamente autónomo.
Por lo que, siguiendo el concepto clásico Franz von Liszt, El delito es un
comportamiento humano típico antijurídico y culpable, y a esto se añade que
sea punible.
De modo que; hemos querido estudiar las posturas más connotadas de las
teorías del delito, tales como: Teoría del cuello blanco- Edwin Sutherland-Explica, describe los delitos
contra la Administración Pública; Señalando como autores a personas con
estatus socio-económico alto y las modalidades típicas son:
Tráfico de influencias
Fraude
Lavado de dinero
Cohecho
Teoría de la anomia: Es una ausencia de normas, los autores sienten bloqueo de
oportunidades en la vida, desarrollan conductas evasivas como; consumo de
drogas, alcoholismo, prostitución, etc. –Durkheim- y Merton
La teoría del delito - Mir Puig (2001: 143-145). La teoría del delito es obra de
la doctrina jurídico-penal y constituye la manifestación más característica y
elaborada de la dogmática del Derecho penal. Esta tiene como objetivo teórico
más elevado la búsqueda de los principios básicos del derecho penal positivo y
su articulación en un sistema unitario. La teoría del delito constituye un intento
de ofrecer un sistema de regulación que controle la problemática penal, que es
ha sido y seguirá siendo el objeto dogmático penal importante para brindar
apoyo al Derecho sustantivo. Por ello citamos a La Teoría del control,
Teoría de la Escuela de Chicago, la Teoría de las ventanas rotas, Teoría de la
oportunidad, Teoría del guante blanco. No han prescindido del estudio de los
delitos contra el patrimonio, y todas tienen el común denominador de
atribución al perfil del autor. Atribución que nosotros compartimos, en su
mayoría estos agentes provienen de hogares disfuncionales, no tienen
competencias para enfrentar las vicisitudes de la sociedad, la facilidad que
hay para el acceso al alcohol y a las drogas. El deseo de adquirir un status socio - económico alto fácil, la falta de políticas de control, la falta de seriedad de las
autoridades e instituciones instructivas, o educativas y administrativas.
Por lo que las tazas antecedentes penales, judiciales y otras que no llegaron tal
fin, pero que están de cifra negra, son sumamente altas.
Este lo estudiamos dentro del método científico jurídico, exegético, deductivo.
Inductivo, analítico, sintético, hermenéutico, heurístico.
Our research is titled: CRIME AGAINST HERITAGE “THE THEFT AGGRAVATED “ LIMA, after observing the problematic reality, we proposed: The general problem. What is the punishment for aggravated robbery - Lima, The General Objective outlines the end of the study. Analyze the punishment of aggravated robbery – Lima. And the general hypothesis; the punishment of aggravated robbery has the maximum penalty; which amounts to life imprisonment-Lima, Both the doctrine and the substantive law coincide in pointing out that aggravated robbery is one of the most serious crimes, among the typical figures of the title Crimes Against Heritage; being its most objective characters: Violence or threat, which are present from beginning to end in the third grade modality; causing death, or serious physical or mental injuries to consummate the appropriation of the property object of the illicit action. Therefore, it is constituted as a completely autonomous criminal type. Therefore, following the classic concept Franz von Liszt, The crime is a typical unlawful and guilty human behavior, and to this is added that it is punishable. So that; we wanted to study the most connoted positions of crime theories, such as: Theory of the white collar-Edwin Sutherland-Explain, describes the crimes against the Public Administration; Indicating as author’s people with high socio-economic status and the typical modalities are: • Influence peddling • Fraud • Money laundering • Bribery Theory of anomie: It is an absence of norms, the authors feel blocked of opportunities in life, they develop evasive behaviors such as; drug use, alcoholism, prostitution, etc. –Durkheim- and Merton The theory of crime - Mir Puig (2001: 143-145). The theory of crime is the work of criminal-legal doctrine and constitutes the most characteristic and elaborate manifestation of the dogmatics of criminal law. This has as its highest theoretical objective the search for the basic principles of positive criminal law and its articulation in a unitary system. The theory of crime constitutes an attempt to offer a regulatory system that controls criminal problems, which is has been and will continue to be the important criminal dogmatic object to support substantive law. For this reason we cite The Theory of Control, Chicago School Theory, Broken Windows Theory, Opportunity Theory, White Glove Theory. They have not dispensed with the study of crimes against property, and all have the common denominator of attribution to the profile of the author. Attribution that we share, most of these agents come from dysfunctional homes, they do not have the skills to face the vicissitudes of society, the ease of access to alcohol and drugs. The desire to acquire an easy high socio-economic status, the lack of control policies, the lack of seriousness of the authorities and educational institutions, or educational and administrative. Therefore, the criminal, judicial and other record rates that did not reach this end, but that are black, are extremely high. We study this within the legal, exegetical, deductive scientific method.
