This research covers, basically, the study of the theory of acquired rights and the theory of accomplished facts, regarding the application of the rules in time in security matters, following the constitutional reform implemented by Law No. 28389, Reform Law of Articles 11, 103 and First Transitional and Final Provision of the Political Constitution of Peru. This law states that the theory of accomplished facts on the regulation of pension regime of Live Certificate, contained in Decree Law No. 20530; it could affect the principle of benign retroactivity of acquired rights for the duration of the 1979 Constitution . This research addresses related to social security, pension rights, the functioning of the pension system in Peru, the scope of constitutional reform implemented by Law No. 28389 , the principle of benign retroactivity in our previous Constitution and posture Constitutional Court on related to the problem to address situations . Finally, special emphasis is given to the figure of the expectaticios rights, the same to be protected and not left homeless by the aforementioned constitutional reform. In this way, it was observed that Law No. 28389 affects the principle of benign retroactivity because it does not contemplate the protection of rights expectations of future survivors, which can be violated with the application of a rule that implies reduction of a pension benefit, by virtue of the theory of accomplished facts, to a previous legal situation.
