The Civil Service Court has issued Administrative Precedent No. 01-2021-SERVIR/TSC dated December 15, 2021, pointing out the appropriate application and interpretation of the graduation criteria when determining the disciplinary sanction to the public servant, in the framework of an administrative procedure. It should be noted that, in the regulations applicable to the disciplinary regime, there is no regulation through which the quantum of the sanctions is objectively determined, being at the complete discretion of the decision of the administrative body that issues it, this has generated multiple pronouncements by the Court facing vast appeals filed by public servants; It should be noted that the sanction of suspension without pay, the norm establishes a maximum of three hundred and sixty-five days, however, it does not establish how to objectively determine the quantum, which illustrates the problem of legal uncertainty that we expose. In that sense, the objective of this work is to expose this legal problem, analyze the impact of the precedent in this context; and, offer recommendations in search of a solution. Consequently, although the purpose of the precedent is for the graduation criteria to be properly interpreted, this being an advance in the face of excess discretion, it is not enough for it to be abandoned in the face of objective-reasonable criteria. For this reason, we recommend a complementary provision of the court establishing a system of thirds, making a division of minimum, medium and maximum sanction, each one indicating quantums, ordered according to the graduation criteria set out by the norm and developed by the precedent.
