This work is based on the analysis of the Judgment issued by the Constitutional Court (File No. 00142-2021-PA/TC), which declared the filed protection claim founded. This case came to the Court through a constitutional grievance appeal, as a consequence of the second instance declaring unfounded the claim for protection in which the null dismissal from which the plaintiff was affected is intended to be annulled. Although, the majority vote was: (1) Declare the claim FOUNDED, declaring the dismissal NULL, (2) Order the reinstatement of the plaintiff in her job and (3) Order the defendant to pay salaries; In addition, a singular vote was cast, declaring the claim partly founded. The analysis will focus on: (1) Determine if the Peruvian State, through the protection process, efficiently guarantees the protection of pregnant women against a null dismissal caused by discrimination and (2) Determine if the normative hierarchy in Peru, granting the Political Constitution of Peru a primary role. For this analysis, research articles and national regulations were consulted. It is concluded that, although there are norms that protect the constitutional rights of pregnant women, there continue to be unjustified dismissals, causing damage, and that despite the fact that the State provides the amparo action as a protection resource, due to the number of demands Currently, this is not efficient. Finally, having this problem as evidence. This work provides alternative solutions.
