The objective of this work is to present and analyze the Judgment issued in Cassation 1315-2017 presented by the Transitory Civil Chamber of the Supreme Court of Justice of the Republic, originated by the Cassation appeal filed by Zandra Wilhelmina Urrunaga Ramirez, against the Resolution hearing, dated October 11, 2016, issued by the Second Civil Chamber Subspecialized in Commercial Matters of the Superior Court of Justice of Lima, the same one that confirmed the resolution on appeal, dated October 27, 2015, which The claim for Third Party Property filed by the plaintiff was declared inadmissible, as it was intended to be inapplicable. In order to develop the analysis of the present work of professional sufficiency, we have consulted several sources, such as legal norms, jurisprudence, books and scientific articles. In this line, we have been able to express our position now to the majority vote. Accordingly, in this paper we will make a critical analysis of the arguments put forward by the judges. Likewise, we will explain why we consider that the majority group of judges is right, since it rescues the importance of the analysis of the literal copy as probative evidence to prove the existence of the property right and, in this way, reach a decision in accordance with the due process.
