The main objective of this research work is to carry out a legal analysis of the ruling issued by the Constitutional Court in Case No. 02695-2021-PA-TC, regarding the appeal for protection filed on the alleged violation of the right to equality and non-discrimination based on the sex of the plaintiff in the free choice to choose the order of the surnames of her minor daughter, as well as the right to identity of the latter. To this effect, we will first seek to establish a clear definition of the fundamental rights mentioned above and recognized in our Political Constitution, their scope and the treatment given to them by the Peruvian legislator, passing, unavoidably, by analyzing the treatment given to such rights in the doctrine and comparative legislation. Only having such concepts clear, we will be able to elucidate if, as it was resolved in the judgment in Case No. 02970-2019-PHC/TC, which served as reference for the decision in the present case, the application of Article 20 of our Civil Code generates or not a violation of fundamental rights by interpreting that this article establishes a specific order regarding the surnames that the children will bear. Finally, we conclude that Article 20 of the Civil Code should be amended to expressly allow parents to agree on the order of precedence of the surnames their children will bear.
