The present work of professional sufficiency has been prepared based on what was developed in the Cassation appeal No. 4765-2018 Arequipa resolved by the Permanent Civil Chamber of the Supreme Court of the Republic, which finds its origins in a case of Divorce De facto Separation filed by Mr. Gerardo Carbajal Bobadilla against Ms. Cenobia Choque. From the study of this case we can see that three different topics are addressed throughout the stages of the process: Family Law (Divorce for Causes), Civil Liability (Compensation for damages) and Constitutional Law (Due Process of Law), this last addressed in the Cassation appeal, whose ruling would annul the judgment of the second instance in the extreme that declared the compensation to the defendant unfounded and would confirm the judgment of the first instance, in the extreme that granted the same. This work takes as sources of consultation the regulations (Civil Code, Civil Procedural Code and New Constitutional Procedural Code), doctrine (Liza Castillo, Lorca Navarrete, Quiroga León, among others) and jurisprudence (Third Cassation Plenary in Civil Law, Sentence of the Constitutional Court 1230-2003-PCH/TC) relating to the matters included in the process, as well as those referring to the procedural part, especially the cassation appeal. The reason for choosing this case is due to the way in which the protection of a constitutional right (Due Process) through civil proceedings changed the course of the process, which became favorable to the defendant's compensation claims thanks to what was decided in the Cassation appeal.
