By means of Cassation Nº 6428-2019 Cajamarca, issued by the Fourth Chamber of Constitutional and Social Transitory Law, it is evident that there is still not full knowledge about the scope of the cause of dismissal for poor performance, which is contemplated in paragraph b) of article 23 of Supreme Decree 003-97-TR. This situation is extremely alarming, since Supreme Decree 003-97-TR is a law that has been in force for more than 25 years in the national legal system, therefore, any doubt regarding its application or interpretation should have already been overcome. However, far from being so, neither the operators of the national justice system, nor the Peruvian legislator have made efforts to clarify or make feasible the requirements for dismissal for poor performance; exposing, on the one hand, employers to affect the due process in labor disciplinary proceedings, and on the other hand, labor specialty judges to misinterpret this ground for dismissal. For these considerations, in the present work of professional sufficiency, we will address the existing national and international normative, doctrinal and jurisprudential scopes with respect to the dismissal for deficient performance regulated in paragraph b) of article 23 of Supreme Decree 003-97-TR, to finally conclude by pointing out which are the possible alternatives of solution to make the dismissal of employees for deficient performance in the labor disciplinary proceedings; for this purpose, we will also review Peruvian and international labor laws, as well as jurisprudence and doctrine.
