This work essentially focuses in analyze Cassation No. 4367- 2019- Arequipa, which revolves around the issue of nullity of the legal act contained in a public deed for the reasons of physically and legally impossible object, illicit purpose, absolute simulation and formality prescribed under sanction of nullity. The process involves the appeal filed by Isaac Javier Arapa Machaca, against the ruling that confirmed the first instance resolution that declared the lawsuit filed by Carlos Enrique Valdivia Ocola founded, regarding the nullity of a legal act, against the Luis Sabino brothers. , Juan Manuel, Marcelina Elva and Lucía Bertha Valdivia Paredes and the spouses Isaac Javier Arapa Machaca and Agueda Epifanía Mamani Chiuche de Arapa regarding the sale of a property owned by the plaintiff but which was registered by the Valdivia Paredes brothers. As a result, the legal relevance of this work focuses on analyzing from a doctrinal and jurisprudential perspective the legal foundations of the concept of nullity of legal acts in cases of sale, good faith in registration, the registration of sales contracts. , in order to know if the sale is void due to the legally impossible purpose of the sale made by heirs with respect to property transferred during the deceased's lifetime, as established by Peruvian regulations.
