Abstract: El presente expediente es el de un proceso arbitral, el cual se derivó de la demanda de presentada por el Sr. RBM y la Sra. LBV. Por un lado, los demandantes señalan que iniciaron un proceso de venta de acciones, el cual fue abandonado injustificadamente, generando un perjuicio material y moral. Por su parte, los demandados señalaron que existieron razones que determinaron la decisión de no celebrar la compra, por lo cual no causó algún daño indemnizable.
Durante el desarrollo del proceso en cuestión, se trataron instituciones jurídicas de suma relevancia, tales como: la oposición del arbitraje por inexistencia de convenio arbitral, así como la indemnización por daños y perjuicios, abarcando daño material y daño moral.
The present file pertains to an arbitration proceeding arising from the claim filed by Mr. RBV and Mrs. LBV. On one hand, the claimants state that they initiated a share sale process which was unjustifiably abandoned, resulting in material and moral damages. On the other hand, the defendants argue that there were reasons that led to the decision not to proceed with the purchase, thus causing no compensable harm. Throughout the course of the aforementioned process, several legally significant concepts were addressed, including the opposition to arbitration due to the absence of an arbitration agreement, as well as compensation for damages, encompassing material and moral harm.
