El estudio de impacto ambiental y el principio de prevención, vinculado con la protección del derecho a gozar de un ambiente adecuado y equilibrado para el desarrollo de la vida

Abstract

Con el presente trabajo se busca determinar de qué manera los EIA garantizan el Principio de Prevención reconocido en el Título Preliminar Artículo VI de la Ley General del Ambiente, Ley N° 28611; para ello se van a describir los fundamentos teóricos del Principio de Prevención revisando y analizando la normatividad internacional y nacional; así como algunas precisiones conceptuales sobre los EIA. Para el desarrollo de la investigación, se ha hecho un breve comentario respecto del Derecho a gozar de un ambiente adecuado y equilibrado para el desarrollo de la vida, hasta llegar al estado actual en el que existe una tensión entre las acciones de las autoridades para promover las inversiones privadas y la obligación de conservar las condiciones de existencia saludable para las personas y todos los seres vivos en general; también se ha elaborado un capítulo respecto a propuestas para el fortalecimiento del Sistema Nacional de Evaluación de Impacto Ambiental con los aportes y sugerencias de los distintos expertos en temas ambientales. Durante el proceso del presente trabajo de investigación, se han empleado los métodos hermenéuticos, analíticos, histórico, entre otros.

With the present work is to determine how the EIA guarantee the Precautionary Principle recognized in the Preliminary Title Article VI of the General Environmental Law, Law No. 28611; for it to be described the theoretical foundations of the Principle of Prevention reviewing and analyzing international and national rules; and some conceptual clarifications about the EIA. For the development of research, has made a short comment regarding the right to enjoy an adequate and balanced development of living room, up to the current state in which a tension between the actions of the authorities there to promote private investment and the obligation to keep the conditions of healthy life for humans and all living beings in general; also contributed a chapter regarding proposals for strengthening the National System of Environmental Impact Assessment with input and suggestions from various experts on environmental issues. During the present investigation, we have used the hermeneutic, analytical, historical methods, among others.
