The investigation relates to the problems warned by the researcher in her professional field linked to the early, but existing, relationships free of couples with consequent carnal access, between a male of eighteen to twenty-one years with a teenage girl over thirteen and under fourteen years of age, whose sexual act for the Penal Code criminality criminals as a crime of sexual rape in her form of sexual rape of minors by lacking the consent of the adolescent legal effects, having been doctrinally and jurisprudentially analyzed the regulation of cases that exceptionally exempt the agent from criminal responsibility, who in some cases having formed a home together with the adolescent and being in the care and upbringing of a minor child, the result of the relationship, faces an investigation and criminal proceedings with an imminent life sentence , and it is also relevant to point out that if the law is literally enforced for conduct; the agent, even if it falls within a range of age to which the same law gives him age-restricted criminal liability, the same rule prohibits such procedural benefit. Similarly, specialists in the research topic were used, resulting in, in a majority way, that there are causes for the agent to be exceptionally exempted from criminal responsibility; the problem was therefore formulated as a statement: What criteria will be considered as grounds for exempting an agent between eighteen and twenty-one years of age from criminal liability for having carnal access with a teenage girl over the age of thirteen and under fourteen, exceptionally
