The present investigation seeks to question the sixth binding precedent contained in the Tenth Plenary Civil Cassation issued not long ago. The rule on which our investigation starts, at our discretion and based on authorized doctrine, is in violation of various procedural principles; especially that of judicial impartiality; Well, if we understand that impartiality is that procedural guarantee that prevents the judge, a subject foreign to the parties in conflict, from behaving or meddling in the inter partes conflict, which means that said subject cannot even minimally carry out any behavior that allows inclining the balance of reason in favor of one of the parties; For this reason, when the judge brings to the civil process means of proof of that defendant declared rebellious, said means beforehand and in the normal order of cases would always end up favoring that defendant, they suppose in all cases an absolute replacement to some of them; Well, in very simple words, the judge is doing what the defendant is solely and exclusively responsible for, answering the claim and thereby alleging defense facts and offering evidence, within the time limit, that supports such facts.
