The present professional sufficiency work aims to verify the adequacy of the fine corresponding to the negative impacts on ecosystem services, caused by deforestation in the Tamshiyacu farm, Loreto-Peru, in the period 2013 – 2016. The general approach is aimed at reviewing and updating the components and method of estimating the fine, especially that associated with environmental damage; the estimation was made through the methods of market prices and transfer of benefits. The analysis of the information corroborated that the calculations made by OEFA and SERFOR had several information gaps when they were made. In the present study, the results showed a calculated fine higher than that estimated by the OEFA in 2020; thus showing that although in some cases environmental damage of great magnitudes can be caused, the individual or entity that caused it, will not always be sanctioned to the same extent as the damage caused. Finally, it is important to add that due to the existing “classification of infractions“, in practice the fine has, to date, a maximum amount of 30,000 UIT, a value lower than the fines that have been referred to above as a product of the valuation of damages to ecosystem services.
