The present work focuses on empirically analyzing the effect of port tariff regulation through the price cap methodology on the concessionary companies’ efficiency. In this context, the hypothesis seeks to explain the direct and positive relation between regulated tariffs and efficiency. Because of this type of regulation, the concessionary companies are encouraged to reduce their costs until the next term of tariff review in order to earn more economic benefits. Sometimes this is reflected in lower tariffs for users, considering that the effect of the price index is less than the productivity factor. The empirical national evidence of the port industry in Peru shows a higher productivity factor in the ports of Matarani, Contenedores Muelle Sur- Callao and Embarque de Concentrados de Minerales-Callao. In addition, there is literature in other sectors in which the positive relation is shown.
