On this occasion, we want to present our investigation, through which the “Trial Period” becomes an abuse by the employer, taking advantage of the poor regulation in our legal system in labor matters. We say it is an abuse, because the respondents consider that its application violates the protection rights that a person who enters to work in private activity should have and not go through a trial period, which many times, once this is concluded, is retired from work, with the argument that since he did not pass said period, he is not suitable for the position. Its inappropriate use is becoming more and more continuous, proof of this is the constant labor lawsuits that labor courts have regarding unjustified or fraudulent dismissals, increasing the procedural burden and generating the expenditure of public money. The trial period is the excuse for the employer to decide the future job after three months whether he likes the worker or not, leaving it to subjectivity and not to how concrete and objective his evaluation should be based on to their performance. Thus, through this work, we seek to contribute to the knowledge of what the inappropriate use of the trial period implies in private activity.
