The present investigation was based on the problem does the Peruvian state bear responsibility for having forgotten people with serious mental disorders, not providing protection to people with serious mental disorders and others of a similar nature, and expose them to commit damages that trigger irreparable consequences for society? And the objective was: to determine whether the Peruvian state is responsible for having forgotten people with serious mental disorders, not establishing protection for people with serious mental disorders and others of a similar nature and expose them to commit damages that trigger irreparable consequences for society. The technique used was the survey and the instrument was the questionnaire. The population was made up of 132 trial lawyers from the province of Maynas, the sample was made up of 98 trial lawyers. The design used in this research is the “non-experimental correlational transactional type“. For statistical analysis we used descriptive statistics, to study the variables independently and to demonstrate the hypotheses we used the parametric test chi square (x2). The results indicated that:the Peruvian state did incur liability and must compensate for having forgotten persons with serious mental disorders, according to article 1972 of the civil code, it does not matter intent or guilt, but the obligation to compensate; The state must guarantee the welfare of the population, and give psychiatric or psychological treatment and protection by authorities to people with mental disorders, if not, they cause harm outside and to other people.
