The present investigation started from the problem: Does the police competence for telephone interceptions affect the constitutional faculty of prosecution of the crime of the Public Ministry? And the objective was: Explain if the police competence granted in D.L. 1182 violates the constitutional attribution of the Public Prosecutor's Office as a crime prosecutor. The technique used was the survey and the instrument was the questionnaire. The population was made up of the IV Macro Police Region of Loreto, the sample was made up of 35 police officers from the different investigation units of the Iquitos City Police Stations and Specialized Units. The design that was used was the non-experimental, transactional correlational type. For the statistical analysis, descriptive statistics were used, for the study of the variables independently and for the demonstration of the hypotheses, the non-parametric chi-square (x2) inferential statistic was used. The results indicated that: The police competence established in Legislative Decree 1182 violates the constitutional power of the Public Ministry to conduct the investigation.
