The present investigation is aimed at demonstrating that the rules for the Preliminary Inquiry established in the new Code of Criminal Procedure complied with the powers and functions identified constitutionally to the National Police of Peru, as for the Public Ministry. Also, we propose to show that the aforementioned rules for the preliminary investigation in the new Code of Criminal Procedure does not involve a submission or loss of autonomy of the National Police of Peru before the Public Ministry, as well as explain that the increase in crime is cause-and-effect relationship with the promulgation of the new Code of Criminal Procedure. To do this, we have structured this work follows: The first title is referred to the approach of the problem, its background, objectives, justification and identification of variables. In the second title we develop the theoretical framework underlying the present investigation, the conceptual framework and the assumptions made. The third title contains the methodology employed in the research: the type and design of the research, tools and techniques of data, population, sample, statistical design, etc. Finally, the fourth title is the presentation and analysis of the results obtained.
