The article 31 of the Consolidated Text of the Labour Legislative Decree No.728, Law of Productivity and Competitiveness, where, in its third paragraph, literally states: “(...) Both in the case referred to in this Article and Article 32 The principle of immediacy be observed “. In this regard, it is clear that the purpose of the principle of immediacy is to provide protection against arbitrary dismissal the worker. Labor Courts of Cusco, in processes where it is based that the dismissal was established due to the breach of the principle of immediacy, according to regulations, should consider whether the time when professional misconduct known until the manifestation of the power sanctioning of the employer (dismissal) was appropriate or reasonable in each case. The criterion is shown from the Supreme Court until the Constitutional Court gives a range of how the judge must weigh this period of application of the principle of immediacy; however, the discretion of each judge is different by the same judicial autonomy and most of all for his human autonomy in how they perceive reality. Therefore, in this thesis will examine whether the deadline for implementation of the principle of immediacy is consistent with the specific case of our local environment, to do the judgments of the 1st Labour Court of the private sector will be delimited and Transitory Court of the private sector, as objects of study of this.
