The present research work analyzes the wording of article 10-A of Supreme Decree No. 007-2002-TR referring to the obligation of the employer to register the performance of work in overtime and the prescription of the evidentiary burden relapsed on the worker when the said registry has deficiencies; this in order to determine its impact on the Principle of Due Process, specifically delimited to the Right to Defense and the Principle of Legal Security. For this purpose, four different types of data collection and analysis technique were applied as analysis of comparative legislation of Spanish-speaking countries such as Spain, Colombia and Mexico; analysis of jurisprudence both in casatoria and second instance judgments; doctrinal analysis of Peruvian legal articles, whose object of study is dealing with the burden of proof in overtime work hours; and conducting interviews in order to collect the appreciation of various specialists in the field (Labor Law). This procedure allowed to conclude that article 10-A of the Supreme Decree N ° 007 2002-TR violates the principle of due process; since the various legal interpretations caused at the jurisprudential level, generate legal insecurity and defenselessness of the defendants.
